Graphic Design Policy

1. Introduction

At Kian Hong Press, we provide professional graphic design services to help businesses create impactful visual identities and marketing materials. This Graphic Design Policy outlines the terms and conditions governing our design projects, including rights, revisions, and usage. By engaging our graphic design services, you agree to comply with this policy.

2. Design Project Scope

The scope of each design project will be defined in the project agreement, which includes the project’s objectives, deliverables, timeline, and associated fees. Any additional work outside the agreed scope will require a separate agreement and may incur additional charges.

  • Design Brief: Clients must provide a comprehensive design brief, outlining the project’s requirements, preferences, and expectations. The quality of the final design depends on the clarity and detail of the initial brief.
  • Revisions: Unless otherwise stated, each project includes up to 3 rounds of revisions. Additional revisions will be billed at our standard hourly rate.

3. Intellectual Property Rights

Upon final payment, Kian Hong Press transfers the ownership rights of the approved design to the client, with the following conditions:

  • Client Ownership: The client owns the final design for use in marketing, branding, and business operations. This includes logos, brochures, and other deliverables created specifically for the project.
  • Designer Rights: Kian Hong Press retains the right to use preliminary concepts, sketches, and rejected designs for portfolio purposes or future projects.
  • Third-Party Materials: Any third-party materials (e.g., stock images, fonts) used in the design are licensed under the terms provided by the original creators. The client must adhere to these licensing terms and may need to purchase a separate license for commercial use.

4. Design Approval Process

The design approval process involves multiple stages to ensure that the final product aligns with the client’s vision. The client will be required to review and approve each stage before proceeding to the next.

  • Initial Concepts: We will present initial design concepts based on the provided brief. Clients can choose one concept to move forward with and request revisions as needed.
  • Feedback and Revisions: Clear and timely feedback is essential to ensure the project stays on track. Revisions should be communicated in writing to avoid misunderstandings.
  • Final Approval: Once the final design is approved, it will be delivered in the agreed format (e.g., PDF, JPG, AI files). No further changes can be made after final approval without incurring additional costs.

5. Payment and Fees

Design projects are billed according to the agreement outlined in the project proposal. The following terms apply:

  • Deposit: A 50% deposit is required to begin the project, with the remaining balance due upon final approval and delivery.
  • Additional Fees: Additional services such as extra revisions, rushed timelines, or major design changes may incur extra fees, which will be communicated before proceeding.

6. Cancellations and Refunds

Design projects may be canceled at any time before the final delivery, subject to the following conditions:

  • Cancellation Before Initial Concepts: If the project is canceled before the initial concepts are presented, the client is entitled to a partial refund, minus a 25% cancellation fee.
  • Cancellation After Initial Concepts: If canceled after the initial concepts are presented, the client is responsible for 50% of the total project cost.
  • No Refunds for Completed Projects: Once the final design has been approved and delivered, no refunds will be issued.

7. Client Responsibilities

To ensure a successful project, the client must:

  • Provide accurate and complete information for the design brief.
  • Respond to communications and provide feedback promptly.
  • Approve design stages in a timely manner to avoid delays.

Failure to meet these responsibilities may impact the project timeline and result in additional fees.

8. Use of Final Design

The client is granted a non-exclusive, royalty-free license to use the final design for its intended purposes, as defined in the project agreement. The client may not resell, redistribute, or modify the design without prior written consent from Kian Hong Press.

  • Modification Rights: If the client wishes to modify the design after delivery, they must contact Kian Hong Press to discuss additional services. Unauthorized modifications may result in the loss of design integrity and quality.

9. Limitation of Liability

Kian Hong Press will not be liable for any incidental, consequential, or indirect damages arising from the use or inability to use the final design, including lost profits, business interruptions, or reputational damage. Our total liability shall not exceed the amount paid for the design project in question.

10. Governing Law

This Graphic Design Policy is governed by and construed in accordance with the laws of Singapore. Any disputes arising from the use of our graphic design services shall be subject to the exclusive jurisdiction of the courts in Singapore.
